By booking with Deep Dish Beach, the Booker/Player agrees to the terms & conditions set out in these conditions. Deep Dish Beach reserves the right to refuse a booking or refuse access or entry to any person/persons without giving a reason.
INTERPRETATION
In these Terms and Conditions ("these conditions"), the following terms shall have the following meanings:

'Venue' A Deep Dish Beach Venue where Activity is taking place

'Booking Form' the booking form available for completion online on Deep Dish Beach website and any external booking booking programme used by Deep Dish Beach.

'Player' the individual who will be attending the Activity as specified in the Booking Form
-
'Booking' the Activity which the Player has booked through the Booking Form
-
'Activity' the Activity which the player is attending, as set out in the Booking Form
-
'Deposit' the Deposit specified by Deep Dish Beach on the website, communicated by Deep Dish Beach or published literature relating to the Services
-
'Fees' the Fees shown on the Deep Dish Beach website, communicated by Deep Dish Beach or published literature relating to the Services
-
'Full Fee Date' the date specified by Deep Dish Beach when the Fees are due
-
'Location' the Location of the Activity (including travelling to and from the Location)
-
'Services' the provision of the Activity for the Player by Deep Dish Beach
-
'Staff' official Deep Dish Beach member of Staff in charge of the Activity or administration
-
'Guests' any person who visits a Deep Dish Beach Venue that is not taking part in an Activity
-
'Booker' The person responsible for submitting the Booking Form.

'Replacement' The person replacing a Player's spot
-
'Equipment' any object that is present at a Deep Dish Beach Venue or used by a member of Staff
-
'Vacation' Activity organised by Deep Dish Beach (generally outside of the UK)
The headings in these Conditions are for convenience only and shall not affect their interpretation.
1. GENERAL
1.1 - Type Of Activity
The following terms & conditions are applicable to all Activity organised by Deep Dish Beach.
1. 2 - Supply of Services

You shall fully complete the Booking Form and supply Deep Dish Beach with all necessary and required information in connection with the Booking.
-
If the selected Activity is fully booked upon receiving your Booking Form, Deep Dish Beach reserves the right to allocate your Booking to the waiting list until a space becomes available.
-
If the Fees are not received by Deep Dish Beach upon completion of the Booking Form, the Booking will be automatically cancelled and your space reallocated. Deep Dish Beach will not accept any cash payments for Activity.
-
Booking does not include; Transport to and from the Venue, food, pocket/lunch money, health insurance, medical insurance and expenses, additional expenses incurred by late pick-ups, anything else that is not outlined on the Deep Dish Beach website.

On acceptance of your booking, Deep Dish Beach will issue a confirmation email. Should you not have received this email, please email info@deepdishbeach.com.
1.3 - Medical
-
Before attending Activity with Deep Dish Beach, players should have permission from a doctor to participate in high intensity exercise. Whilst attending Activity at Deep Dish Beach, regular health and medical screening should be sought from a general practitioner. Players must make Deep Dish Beach aware of any previous medical issues prior to attending Activity.

Players must make Staff aware of any injuries, pains or concerns prior to Activity taking place. It is however the player’s choice to participate and no liability will be placed on Deep Dish Beach or its staff for injury, illness or death as a result of the pre-existing injury.

If a Player feels dizzy, faint, unwell, or any unusual pain they must stop exercising and inform a member of staff immediately. Although Deep Dish Beach is sensitive to certain allergens, it cannot guarantee their exclusion from any venues.
1.4 - Materials

Should a Player have any questions about equipment, they should ask the closest member of Staff to show how it is safely used. This is the player’s responsibility. Should a member of Staff not be present at the time of Activity, it is the responsibility of the Player to seek expert advice.

Attire - It is necessary that all Players and Guests wear appropriate, clean attire when attending sessions.
1.5 - Liability

The Player and Guest agrees to indemnify and to keep Deep Dish Beach indemnified, against liabilities, loss, damage, expense, costs and claims by any person in respect of injury, loss or damage to property however caused during Activity or spectating.

Deep Dish Beach shall have no liability to the Player for any loss, damage, costs, expenses or other claims for compensation arising from the Player's late arrival, non-arrival, cancellation , or any other fault of the Booker or the Player.
-
The Booker accepts responsibility for any damage caused to the Venue during the period of Activity by the Player and will be liable for the costs of rectifying the damage.
-
In the event of a serious incident or misbehaviour, such as fighting, racial abuse, harassment, use of illegal substances or damage to property, Deep Dish Beach will insist that Staff make arrangements to remove the Player/s from the Venue.

Deep Dish Beach reserves the right to alter Activities as it thinks fit and without notice.
-
Deep Dish Beach will not be bound by any statement unless it is in writing and authorised by a senior member of Deep Dish Beach Senior Management.

Where Deep Dish Beach provides, in connection with the provision of the Services, any goods or equipment or Services supplied by a third party, Deep Dish Beach does not give any warranty, guarantee or other terms as to their quality, fitness for purpose, performance or otherwise.
1.6 - Booker Responsibility
-
During Activity where a Booker has booked Activity for multiple Players who have not submitted a Booking Form (court hire, private events etc). The Booker will take responsibility for:

Ensuring the Venue to be used is suitable for the Activity and safe for use by the Players
-
Ensuring that all Equipment meets the standards in force at the time of the Activity. Any defective Equipment is not to be used and must be reported to Deep Dish Beach immediately
-
Any policies, procedures and risk assessments specific to the Activity and Players
-
The behaviour of all Players and Guests associated with the Activity
-
Any damage caused to the Venue during the period of Activity by the Player and will be liable for the costs of rectifying the damage.
-
Comply with any reasonable request from a member of Staff.
-
Ensuring that they or their representative is present throughout the Activity
-
The liaison with Deep Dish Beach Staff when called upon to do so during the Activity
-

The Booker agrees to be wholly liable for any and all actions and/or omissions of the Player booked for. Without prejudice to the generality of the foregoing, the Booker shall be liable for any liability, financial or otherwise, or injury or damage to property caused by the Player whilst at the Venue, and shall fully indemnify Deep Dish Beach, their agents, contractors and/ or Staff for any loss, damage, costs or expenses resulting from such liability, injury or damage.
1.7 - Playing Surface & Public Spaces

Deep Dish Beach do their upmost to ensure playing surfaces are safe for Players to play on and environments are safe. This includes but not limited to:

Regular checks of the sand for potential harmful objects
-
Suitable clearance zones in place around playing areas
-
Potential risk of public
-
-
However there is a limit to how safe we can make a playing environment (especially public spaces), therefore it is the responsibility of the Player to also be vigilant for harmful objects, unsuitable clearance zones and other potential risks. Any risks must be reported immediately to Deep Dish Beach. The Player agrees to indemnify Deep Dish Beach for any injury, illness or death that may come as a result of these risks, as stated in section 1.5.

Deep Dish will carry out Risk Assessments for all Activity and Vacations. These can be found HERE
1.8 - Insurance

Deep Dish Beach Ltd has Public/Employee Liability insurance cover, and an insurance certificate can be viewed on our Important Documents Page.

We do not exclude or limit in any way our liability for:
-
Death or personal injury caused by our negligence of our employees, agents, or subcontractors.
-
Fraud or fraudulent misrepresentation
-
Breach of any term of the Consumer Rights Act 2015
-

In the event of non-compliance with these Terms, Deep Dish Beach Ltd shall be liable for any loss or damage you incur that arises as a foreseeable consequence of our breach or negligence. We shall not, however, be held responsible for any loss or damage that does not constitute a foreseeable outcome of such breach of these Terms.
1.9 - Publicity
The Booker acknowledges that Deep Dish Beach may use, for publicity purposes and without prior notification, any photograph or video taken of the Player at the Venue, and any statement (whether written or oral) made by you or the Player. You may exclude the Player from being photographed/filmed on your Booking Form (Junior Activity), or at any point, by emailing info@deepdishbeach.com.
1.10 - Force Majeure
Deep Dish Beach shall not be liable for any delay in performing or failure to perform any Activity (including to action any alteration or cancellation) due to any case beyond our reasonable control including lock-outs, strikes, shortages of personnel, labour disputes, war, riot, act of God, civil commotion, terrorism, malicious damage, threats to safety, compliance with any law or governmental order, rule, regulation or direction, accident, environmental contamination, pandemic outbreak of disease, breakdown of plant or machinery, fire, flood, difficulty or increased expense in obtaining workmen, materials, goods or raw materials in connection with the performance of this agreement. No refund will be made, except at Deep Dish Beach discretion.
1.11 - Rules & Regulations

Deep Dish Beach reserves the right to make rules and regulations relating to the Players participation in the Activity ('Code of Conduct'). The Code of Conduct forms part of these Conditions and are available HERE

Any failure by the Player to adhere to the Code of Conduct may result in their participation in the Activity being terminated without refund.
-
Deep Dish Beach reserves the right to suspend, refuse or exclude any Player at any point during the Activity or before, if it is thought that their presence may be detrimental to the wellbeing of the other Players or Staff.
2. CLUBS ACTIVITY POLICY
The following terms are applicable to specific Activity organised by Deep Dish Beach at Deep Dish Clubs only.
2.1 - Classes & Socials

Players under the age of 16 are not able to attend unless given authorisation to do so by Deep Dish and MUST to be accompanied by a parent/guardian. The parent/guardian takes full liability for the Player.
-
Players aged 16 to 18 must have parental or guardian permission to attend, which must be provided via the Booking Form. An emergency contact must also be supplied.The parent or guardian assumes full liability for the player’s participation.
2.2 - Court Hire
-
A maximum of 12 people are allowed to enter the Venue for each court booked, this includes spectators. Should the number of people exceed this, the Booker will be charged for an additional court at twice the standard hourly rate.
-
If a Booker wishes to continue using the courts beyond the originally booked time, and the courts are available, they must notify Deep Dish by emailing info@deepdishbeach.com within 2 hours of the end of the original booking. This is necessary because the Booking System does not display availability for past time slots, and therefore cannot be used for immediate extensions. Deep Dish will invoice the Booker directly at the standard rate for the additional time. Failure to notify Deep Dish within this timeframe will result in the following: (see below)

If a customer remains on the court beyond their allotted and paid-for time without prior agreement, they will be charged twice the standard hourly rate for the extra time used. This penalty is applied to discourage unauthorised extension of use and ensure fairness to other users.

General court bookings are for recreational play only. Private or group coaching, paid or unpaid instruction, training sessions, clinics, or any form of organised coaching is strictly prohibited unless expressly authorised by the venue. The venue reserves the right to refuse entry, terminate the booking without refund, or take further action if unauthorised coaching is found to be taking place.
2.3 - Tournaments & Clinics

Players under the age of 16 at non junior events MUST be accompanied by a parent/guardian. The parent/guardian takes full liability for the Player.
-
Players aged 16 to 18 must have parental or guardian permission to attend, which must be provided via the Booking Form. An emergency contact must also be supplied.The parent or guardian assumes full liability for the player’s participation.
2.4 - Junior Activity
The following are applicable to Junior (Under 18) Activity organised by Deep Dish Beach and are supplementary to the entirety of the terms & conditions set out on this page. Junior Activity includes but is not limited to:

Junior Tournaments
2.4.1 - Drop off and Collection
-
The player must be picked up and dropped off at the times specified by Deep Dish Beach.
-
The Booker agrees to incur extra charges if the Player is picked up after the specified times. Deep Dish Beach reserves the right to exclude Players without refund if collection is persistently late.
-
With the written permission of a guardian, Players aged 12 and above may make their own way to and from the venue.
2.4.2 - Medical and Behavioural
-
Any medical or behavioural problems of the Player known to the Booker must be shared with Deep Dish Beach in writing on the Booking Form. Deep Dish Beach reserves the right not to accept the Booking on the grounds that any such medical or behavioural information is not conducive to the Players or other Players' participation in the Activity.
-
If any Player, or guardian shows signs of Covid-19 on arrival, the Player will be refused entry. A partial refund or transfer of credit may be made at the discretion of Deep Dish Beach.
-
If any Player presents symptoms of Covid-19 during the camp, they will be asked to use the Venue isolation space and the Players emergency contact, as stated on their Booking Form, will be notified immediately. If the Player is not collected, they may remain in the isolation space for the duration of the day. A partial refund or transfer of credit may be made at the discretion of Deep Dish Beach.
2.4.3 - Safeguarding
Deep Dish Beach will react to concerns, allegations and suspicions of abuse or neglect, in line with the Deep Dish Beach safeguarding policy, and procedure. More information can be found
2.5 -Spectator Events

Spectators for ticketed events must bring proof of booking and ID to enter the venue.
-
Children under the age of 14 must be accompanied by an adult.
-
Spectators must be respectful to all staff, officials and athletes at the event.
-
Deep Dish Beach staff reserve the right to check bags on entry and within the venue.
-
The following items are banned from spectator events:
-
Food, Drink, Drugs, Weapons, Bags larger than 40x20x25cm, Large umbrellas, Glass, Alcohol, Pushchairs, Selfie sticks, Weapons and tools, flares, lasers, smoke devices and canisters, Large-bodied cameras and camcorders, Drones, Unauthorised musical instruments and vuvuzelas.

3. CLUBS ACTIVITY CANCELATION
The following terms are applicable to specific Activity organised by Deep Dish Beach at Deep Dish Clubs only and booked and managed through Deep Dish's booking system (https://deepdishbeach.played.co/).
3.1 - Classes & Socials
-
If a cancellation is made more than 48 hours before the start time of the booked Activity, the Booker is able to reschedule the booking directly through the Deep Dish booking system. Reschedule link can be found in booking confirmation email.
-
Rescheduling must be for the same product and can only be rescheduled once.
-
Rescheduling must be for the same season (Winter or Summer where applicable)
-
Within 48 hours of the Activity, under no circumstances will the Booker receive a refund or be able to reschedule.
-
Rescheduling may not always be possible. In this case, Deep Dish will not be liable for the Booking cancellation
-
Transfer of Booking to another Player is not possible.

Refunds not available
3.1.1 - Season Passes - Classes & Socials

Refunds not available
-
A booker may transfer their season pass to a different session if they have been directed to do so by a Deep Dish member of staff.
-
Transferring a booking is subject to availability.
-
Booker must email info@deepdishbeach.com to organise a transfer.
3.2 - Court Hire
-
If a cancellation is made more than 48 hours before the start time of the booked Activity, the Booker is able to receive a full refund of the booking directly through the Deep Dish booking system. Refund link can be found in booking confirmation email.

Within 48 hours of the Activity, under no circumstances will the Booker receive a refund or be able to reschedule.

Transfer of Booking to another Player is not possible.
3.2.2 - Season Passes - Court Hire

A booker may transfer their season pass to a different day/time, subject to availability.

Booker must email info@deepdishbeach.com to organise a transfer.
3.3 - Training Clinics
-
If a cancellation is made more than 14 days before the start time of the booked Activity, the Booker is able to receive a full refund of the booking directly through the Deep Dish booking system. Refund link can be found in booking confirmation email.

If a cancellation is made more than 7 days before the start time of the booked Activity, the Booker is able to reschedule the booking directly through the Deep Dish booking system. Reschedule link can be found in booking confirmation email.
-
If a Booker cancels their Activity within 7 days of the event, they may be able to reschedule if they are able to be replaced by someone on the waiting list or they have found a suitable replacement. The Booker must contact Deep Dish direct via info@deepdishbeach.com.
-
Within 48 hours of the Activity, under no circumstances will the Booker receive a refund or be able to reschedule.
-
Rescheduling may not always be possible. In this case, Deep Dish will not be liable for the Booking cancellation
3.4 - Tournament Cancellation

If a cancellation is made more than 14 days before the start time of the booked Activity, the Booker is able to receive a full refund of the booking directly through the Deep Dish booking system. Refund link can be found in booking confirmation email.

If a cancellation is made more than 7 days before the start time of the booked Activity, the Booker is able to reschedule the booking directly through the Deep Dish booking system. Reschedule link can be found in booking confirmation email.

If a Booker cancels their Activity within 7 days of the event, they may be able to reschedule if their is a team on the waiting list or they have found a suitable replacement. The Booker must contact Deep Dish direct via info@deepdishbeach.com.

Within 48 hours of the tournament, under no circumstances will the Booker receive a refund.
Player Replacement
-
If the Booker wishes to replace a Player, this must be emailed to info@deepdishbeach.com providing all details including, but not limited to; full names, email addresses and UKBT membership numbers and contact number.
3.5 - Kids Holiday Camps
-
For cancellations made more than 2 weeks before juniors camp - Full refund will be give

Rescheduling is available if requested more than 7 days before Junior Camp.

No Refund or Rescheduling is available within 7 days before Junior Camp
3.6 - The Sixes Cancellation/Replacement
-
The Booker can cancel their Activity up to 28 days before the event, by emailing info@deepdishbeach.com, and will receive a full refund.
-
If a Booker cancels their Activity within 28 days of the event, they will not receive a refund unless the tournament is full and there is a team on the waiting list to directly replace them.
-
Within 7 days of the tournament, under no circumstances will the Booker receive a refund.
Team Replacement
If the Booker wishes to replace their team, this must be emailed to info@deepdishbeach.com providing all details including, but not limited to; full names, email addresses and contact number.
3.7 - Spectator Events Cancellation
Tickets are fully refundable or exchangeable 7 days before the date of the event booked. After this point, tickets are neither refundable nor exchangeable.
All cancellations must be officially made in writing to info@deepdishbeach.com. Official cancellation time will be from when the email is received by Deep Dish Beach. If for any reason, Activity is cancelled by Deep Dish Beach, the total liability of Deep Dish Beach will not exceed that proportion of the Fees Deep Dish Beach have actually received.
Deep Dish Beach will not be held liable, or be required to pay compensation for any loss incurred as a result of, or in any way arising out of the cancellation.
The following Activity is booked and managed through forms on the Deep Dish website. Please see cancellation/rescheduling policies for each activity below:
3.8 - Junior Club Cancellation

Cancellation made within 48 hours of Booking - All funds will be refunded. Unless a session has already been attended, in which case a cost of £20 will be deducted and the rest will be refunded.
-
For cancellation more than 2 weeks before the start of the term - Cancellation fee of £10 will be incurred
-
For cancellations made more than 7 days before the start of the term - 50% of Fees will be refunded
-
For cancellations made less than 7 days before the start of the term - No refund of Fees will be given
-
Transfer of Booking to another Player is not possible.
The following Activity is booked and managed directly through communication with info@deepdisbeach.com. Please see cancellation/rescheduling policies for each activity below:
3.9 - Private Event/Party/Class/Clinics – Single Booking on a single date
Only applicable to no more than one private Booking being made in a single Booking. A deposit may be required by Deep Dish Beach to secure the Booking.

Deposits are non-refundable or transferable.

Cancellation made more than 14 days prior to the Booking taking place – A refund may be possible if final Booking Fee has been paid to Deep Dish Beach.

Cancellation made more than 7 days prior to the Booking taking place – Booker is able to reschedule the Booking within 1 year of the original Booking date. Booking is only able to be reschedule once from the original date.

Cancellation made less than 7 days prior to the Booking taking place – No refunds or reschedules possible.

Cancellation made within 48 hours of Booking Form submitted – All Fees refunded
3.10 - Private Event/Party/Class – Multiple Bookings for multiple dates
Only applicable to Bookings where a Booking is made for multiple dates in a single Booking. A deposit may be required by Deep Dish Beach to secure the Booking.

Deposits are non-refundable or transferable.

Cancellation made more than 72 hours prior to the Booking taking place – Booker is able to reschedule the Booking within 3 months of the original Booking date. Booking is only able to be reschedule once from the original date.

Cancellation made within 72 hours prior to the Booking taking place – No refunds or reschedules possible.
-
Cancellation made within 48 hours of Booking Form submitted – All Fees refunded
3.11 - Private Venue Hire
Only applicable to Bookings where a Booker has hired the entire facility. A deposit will be required by Deep Dish Beach to secure the Booking.

Deposits are non-refundable or transferable.
-
Cancellation made more than 28 days prior to the Booking taking place - A refund may be possible if final Booking Fee has been paid to Deep Dish Beach.

Cancellation made more than 14 days prior to the Booking taking place - Booker is able to reschedule the Booking within 1 year of the original Booking date. Booking is only able to be reschedule once from the original date.

Cancellation made within 48 hours of Booking Form submitted – All Fees refunded
4. VACATIONS
The following terms apply specifically to Vacations organised by Deep Dish Beach Ltd and are supplementary to the general Terms & Conditions set out on this page.
“Vacation” includes, but is not limited to:

Gran Canaria Camp
-
Portugal Camp
-
Tenerife Camp
-
Utrecht Camp
-
Valencia Camp
4.1 Supply of Services
-
Deep Dish Beach Ltd (“Deep Dish”) shall provide the Services to the Player subject to these Terms & Conditions. By submitting a Booking Form and paying the Deposit, the Booker agrees, on behalf of themselves and the Player (where different), to be bound by these Terms & Conditions.
-
Bookings are accepted at the discretion of Deep Dish and are not transferable.
-
The Booker must complete the Booking Form in full and provide all information reasonably required by Deep Dish in connection with the booking.
-
If the selected Vacation is fully booked when the Booking Form and Deposit are received, Deep Dish may place the Booker on a waiting list until a space becomes available. If no space becomes available, the Deposit will be refunded.
-
A booking is only valid once both the completed Booking Form and Deposit have been received and the booking has been accepted by Deep Dish. If either is not received, Deep Dish may cancel the booking and reallocate the space.
4.2 Payment of Fees
-
The Booker shall pay Deep Dish the Fees and any additional costs agreed between the Booker and Deep Dish in connection with the Services.
-
Unless expressly stated otherwise on the Deep Dish website or booking information, Fees do not include:
-
Accommodation
-
Flights
-
Transfers to or from the hotel or airport
-
Pocket money
-
Souvenirs
-
Health or medical expenses
-
Travel insurance
-
Required travel visas
-
Any other items not expressly included in the relevant Package.
-

The Deposit is non-refundable, except where the booking is not accepted by Deep Dish or where these Terms & Conditions expressly provide otherwise.
-
No booking is valid until both the Booking Form and Deposit have been received and the booking has been accepted by Deep Dish.
-
Following acceptance of the booking, Deep Dish will issue a confirmation email. If the Booker does not receive this confirmation, they should contact Deep Dish at deepdish@kaboodle.co.uk.
-
If the remaining balance is not received by the Full Fee Date, Deep Dish may terminate the booking by contacting the Booker using the email address provided at the time of booking. In such circumstances, the Deposit will not be refunded.
-
Where a Booking Form is submitted after the Full Fee Date, it must be accompanied by payment of the full Fee. The booking will only be confirmed once accepted by Deep Dish.
-
Deep Dish does not accept cash payments for Services.
4.3 Cancellation
-
If a Booker wishes to cancel a booking for any reason, they must notify Deep Dish by email.
-
All cancellations must be made in writing by email to deepdish@kaboodle.co.uk. The cancellation will take effect when the email is received by Deep Dish.
The following cancellation terms apply:
4.3.1 Cancellation within 48 hours of submitting the Booking Form
-
All payments made will be refunded.
4.3.2 Cancellation before the Full Fee Date
-
The Deposit will be forfeited.
-
Any Package extras already purchased, including accommodation, must be paid for in full.
-
Any other Fees already paid will be refunded.
4.3.3 Cancellation after the Full Fee Date
-
The Deposit will be forfeited.
-
The outstanding Fees for the Package selected by the Booker will become due and payable.
-
Any Fees already paid will not be refunded.
4.3.4 Cancellation within 4 weeks of the Vacation
-
The Deposit will be forfeited.
-
The outstanding Fees for the Package selected by the Booker will become due and payable.
-
Any Fees already paid will not be refunded.
-
Replacement Players will not be accepted.
-
Where a cancellation is subject to different rights under applicable law, those rights will apply.
4.4 Replacement Players
-
Deep Dish will use reasonable efforts to assist in finding a replacement where a Player cancels. Players may also identify their own replacement.
-
Any replacement must be approved by Deep Dish and must be a like-for-like replacement, purchasing the same Package, accommodation and additional extras as the original Player.
-
Any costs or differences arising because the replacement does not purchase the same Package, accommodation or extras will remain payable by the original Player.
-
A replacement Player must be able to receive the Services associated with the original booking.
4.4.1 Cancellation and replacement before the Full Fee Date
-
The Deposit will be refunded less a £30 administration charge.

The refund will only be processed once the replacement Player's Deposit has been received by Deep Dish.
4.4.2 Cancellation and replacement more than 4 weeks before the Vacation

The original Player's Deposit will be forfeited.

Any additional Fees paid for the Package will be refunded once the replacement Player's full Fee has been received by Deep Dish.
4.4.3 Cancellation within 4 weeks of the Vacation

Replacement Players are not permitted.

The cancellation terms in Section 4.3 will apply.

Any additional costs reasonably incurred by Deep Dish as a result of a replacement may be charged to the original Player.

The replacement Player must accept the Services and arrangements associated with the original booking. This may include, but is not limited to:

Accommodation arrangements
-
Bespoke Vacation materials, including goody bags or clothing

Training group allocation
-
Other arrangements already made for the original Player.

4.5 Rules, Regulations and Player Liability
-
The Booker is responsible for the actions and omissions of the Player and may be liable for loss, damage, costs or expenses caused by the Player's actions or omissions.

Deep Dish may establish reasonable rules and regulations governing participation in the Vacation (the “Code of Conduct”). The Code of Conduct forms part of these Terms & Conditions and is available HERE.

Deep Dish will endeavour to accommodate reasonable requests regarding training times, group allocations or participation alongside specific individuals where those requests are made at least one month before the Vacation. Such requests are not guaranteed and remain subject to operational, coaching, participant-level and logistical considerations.

Players are responsible for accurately assessing and providing their playing level when booking. Deep Dish reserves the right to assess a Player's level during the Vacation and, where necessary, move them to a more appropriate training group or activity. Deep Dish will always endeavour to accommodate a Player in a suitable group where possible; however, group sizes, capacity and the structure of a particular Vacation may mean that an appropriate alternative group is not available. Where a Player's playing level is not suitable for the advertised level of the camp or training group and no suitable alternative is available, Deep Dish reserves the right to restrict or refuse the Player's participation in training or other activities, without refund. Failure to comply with the Code of Conduct may result in the Player's participation in the Vacation being terminated without refund.

Deep Dish may withdraw a Player from an activity at any time where it considers this necessary for safety or because the activity is unsuitable for that Player.

Deep Dish will take reasonable steps in relation to known allergens but cannot guarantee that allergens will be completely excluded from the Vacation.

No person under the age of 18 may attend a Vacation unless expressly approved in writing by Deep Dish and accompanied by a parent or guardian.

Deep Dish is not responsible for actions undertaken by Players while under the influence of alcohol, drugs or illegal substances.

The following are prohibited at Vacations: illegal substances, drugs, legal highs, nitrous oxide and associated equipment including balloons, unidentified substances, new psychoactive substances (NPS), and other illegal items.
4.6 Liability

Where goods, equipment or Services are provided by third parties in connection with a Vacation, Deep Dish will use reasonable care in selecting and arranging those Services but cannot guarantee the quality, performance or suitability of third-party goods, equipment or Services.

Deep Dish will not be liable for loss, damage, costs or expenses arising from a Player's late arrival, non-arrival or other failure to comply with their responsibilities under these Terms & Conditions.

Deep Dish may make reasonable changes to programmes, activities, itineraries, excursions, premises, personnel, coaches, training groups or other arrangements where necessary for operational, safety, logistical or other reasonable reasons.

No statement or representation will be binding on Deep Dish unless it is made in writing and authorised by a member of Deep Dish Senior Management.

Deep Dish is not responsible for loss of or damage to jewellery, electronics or other valuables brought to the Venue by a Player.

Deep Dish is not responsible for property left at the Venue by a Player. Unclaimed property may be disposed of where it is not collected within a reasonable period after the Vacation.

Players are responsible for arranging appropriate personal insurance for the duration of their stay.
4.7 Medical and Behavioural Information

Any medical, behavioural or other information known to the Booker that may affect the Player's participation in the Vacation must be disclosed to Deep Dish during the booking process.

Deep Dish may decline a booking or restrict participation where, based on the information provided, it reasonably considers that participation may be unsuitable or unsafe for the Player or other participants.
4.8 Publicity

Deep Dish may take photographs and video footage during Vacations for promotional and publicity purposes.

By participating in a Vacation, the Player acknowledges that they may appear in photographs or video footage taken during the Vacation and that such footage may be used by Deep Dish for promotional purposes.

Deep Dish may also use statements or feedback provided by the Booker or Player for promotional purposes.
4.9 Sharing of Information

Where a Player books onto a Vacation as part of a group, the Booker consents to Deep Dish sharing the Player's name, email address and telephone number with the relevant group leader for the purpose of organising and communicating about the Vacation.

Deep Dish is not responsible for the actions or use of this information by the group leader.
4.10 Force Majeure

Deep Dish will not be liable for any delay in performing, or failure to perform, an obligation where this results from circumstances beyond its reasonable control.

Such circumstances may include, but are not limited to, strikes, lock-outs, labour disputes, shortages of personnel, war, riot, civil unrest, terrorism, malicious damage, threats to safety, changes in law or government requirements, accidents, environmental contamination, pandemics or outbreaks of disease, breakdown of plant or machinery, fire, flood, or difficulty or increased expense in obtaining labour, materials, goods or services.

Where such circumstances affect the provision of a Vacation, Deep Dish may make reasonable changes to, suspend or cancel affected Services where necessary.

Where a refund or other remedy is expressly provided elsewhere in these Terms & Conditions, that provision will apply.
5. WEATHER POLICY
The purpose of this policy is to ensure the safety and well-being of all participants, officials, and spectators involved in beach volleyball events by establishing clear guidelines for weather-related decisions.
This policy applies to all Activity organised by Deep Dish Beach.
Weather Conditions and Guidelines
5.1 - Temperature
-
Extreme Heat - If the temperature exceeds 40°C, play will be suspended until temperatures drop to a safe level. Water must be accessible and shaded areas where possible will be provided. Mandatory water breaks every 15 minutes durig play for temperatures above 40°C.

Cold Weather - Play may continue in temperatures as low as 0°C provided that players are dressed appropriately and the playing serfice is suitable.
5.2 - Thunderstorms and Lightning

Play will be suspended immediately if lightning is observed or thunder is heard. The 30-minute rule will be enforced: play can resume 30 minutes after the last instance of lightning or thunder.

Participants and spectators must seek shelter in an enclosed building or vehicle during this time.
5.3 - Rain
-
Light rain: Play will continue.

Heavy rain: Play will continue unless there is standing water on the court.
5.4 - Wind
-
Sustained winds exceeding 50 mph will result in suspension or cancellation.
5.5 - Sand Conditions
-
Excessively hot sand: Measures such as wetting the sand or providing protective footwear may be taken.

Unsafe debris: Courts will be inspected before play and any hazardous debris will be removed.

Decision-Making Authority - The on-site tournament director or head official/organiser has the authority to make weather-related decisions, including suspending or resuming play.

Decisions regarding weather delays, suspensions, or cancellations will be communicated promptly to all participants and spectators via WhatsApp Club Group Chats and/or Email if prior to a session or tournament. Otherwise it will be in person communication
5.6 - Rescheduling

If an event is canceled due to weather conditions, efforts will be made to reschedule at the earliest convenience or if a rescheduling is not possible then a refund will be offered. Participants will be notified of rescheduling details through email.
5.7 - Preparedness

All participants are encouraged to check weather forecasts prior to attending events and to come prepared with appropriate clothing and supplies.

By adhering to this weather policy, Deep Dish Beach aims to provide a safe and enjoyable environment for all beach activities.
6. DATA PROTECTION
Personal information requested on the Booking Form is held on computer and used by us in connection with the Booking. Where necessary we share personal information with our Staff, agents, subcontractors and other third parties for the purpose of fulfilling the Services Booked. We take full responsibility for ensuring that proper security measures are in place to protect personal information.
Marketing - By Booking an Activity with Deep Dish Beach, the Booker agrees to be subscribed to the Deep Dish Beach e-mail subscription service. The Booker will be able to unsubscribe from the email subscription list upon receipt of their first marketing email. Email addresses will never be passed to a third-party for marketing purposes.
7. COMPLAINTS
If any problem is experienced during the Activity booked, this should be immediately reported to the member of Staff to allow us the opportunity to rectify any problem raised. If it is not resolved you should write to us within 28 days of the incident and we will endeavour to find a satisfactory solution. You must email complaints to info@deepdishbeach.com.
